Based on the findings of an onsite unannounced state re-licensure survey conducted on October 25, 2022, Nurse Next Door of Chester County was found to be in compliance with the requirements of 28 Pa. Code, Health Facilities, Part IV, Chapter 51, Subpart A.

Based on the findings of an onsite unannounced home care agency state re-licensure survey conducted on October 25, 2022, Nurse Next Door of Chester County was found not to be in compliance with the requirements of 28 Pa. Code, Health Facilities, Part IV, Chapter 611, Subpart H. Home Care Agencies and Home Care Registries.

611.51(a) LICENSURE
Hiring or Rostering Prerequisites

Name - Component - 00
Prior to hiring or rostering a direct care worker, the home care agency or home care registry shall: (1) Conduct a face-to-face interview with the individual. (2) Obtain not less than two satisfactory references for the individual. A satisfactory reference is a positive, verifiable reference, either verbal or written, from a former employer or other person not related to the individual that affirms the ability of the individual to provide home care services. (3) Require the individual to submit a criminal history report, in accordance with the requirements of § 611.52 (relating to criminal background checks), and a ChildLine verification, if applicable, in accordance with the requirements of § 611.53 (relating to child abuse clearance).

Observations:

Based on reviews of personnel files (PF) and interview with agency owner the agency failed to ensure documentation of a face to face interview being completed for three (3) of five (5) files reviewed. PF #1, #2, & #5.; failed to ensure documentation of two (2) verified, satisfactory reference checks being completed for five (5) of five (5) files reviewed. PF #1-5.

Findings include:

Review of personnel files (PF) completed 10/25/22 between approximately 9:50AM and 11:00AM revealed:

PF #1, Date of Hire (DOH): 11/1/21, contained no documentation showing a face to face interview had been completed or two (2) satisfactory references had been verified.

PF#2, DOH: 6/20/22, contained no documentation showing a face to face interview had been completed or two (2) satisfactory references had been verified.

PF #3, DOH: 6/8/22, contained no documentation two (2) satisfactory references had been verified

PF#4, DOH: 3/4/22, contained no documentation two (2) satisfactory references had been verified

PF #5, DOH: 3/18/22, contained no documentation showing a face to face interview had been completed or two (2) satisfactory references had been verified.


Interview with Agency owner complete October 25, 2022 at approximately 2:00PM confirmed the above findings.

Thank you.
We have added a new onboarding tracker sheet to our new hire folder. This tracker includes a record of all hiring activities (screening, interview, background check, reference check) etc along with time completed. This sheet will be initialed for each activity by the agency employee finishing the check. The tracker will be signed by agency care designer or administrator.

For existing records, we will right away start the action of adding tracker and putting in correcr dates.

Prohibitions

(b) No individual as a result of the individual's affiliation with a home care agency or home care registry may assume power of attorney or guardianship over a consumer utilizing the services of that home care agency or home care registry. The home care agency or home care registry may not require a consumer to endorse checks over to the home care agency or home care registry.

Observations:

Based on review of consumer files (CF) and interview with agency owner the agency failed to ensure documentation that consumers had been notified of prohibitions prior to commencement of services for five (5) of five (5) files reviewed. CF #1-5.

Findings include:

Review of consumer files completed October 25, 2022 between approximately 12:00PM and 2:00PM revealed:

CF #1, Start of care (SOC): 10/6/22; contained no documentation showing the consumer had been provided the following information prior to the start of services: "No individual as a result of the individual's affiliation with a home care agency or home care registry may assume power of attorney or guardianship over a consumer utilizing the services of that home care agency or home care registry. The home care agency or home care registry may not require a consumer to endorse checks over to the home care agency or home care registry".
CF #2, (SOC): 8/19/22; contained no documentation showing the consumer had been provided the following information prior to the start of services: "No individual as a result of the individual's affiliation with a home care agency or home care registry may assume power of attorney or guardianship over a consumer utilizing the services of that home care agency or home care registry. The home care agency or home care registry may not require a consumer to endorse checks over to the home care agency or home care registry".
CF #3, (SOC): 8/17/22; contained no documentation showing the consumer had been provided the following information prior to the start of services: "No individual as a result of the individual's affiliation with a home care agency or home care registry may assume power of attorney or guardianship over a consumer utilizing the services of that home care agency or home care registry. The home care agency or home care registry may not require a consumer to endorse checks over to the home care agency or home care registry".
CF #4, (SOC): 10/11//22; contained no documentation showing the consumer had been provided the following information prior to the start of services: "No individual as a result of the individual's affiliation with a home care agency or home care registry may assume power of attorney or guardianship over a consumer utilizing the services of that home care agency or home care registry. The home care agency or home care registry may not require a consumer to endorse checks over to the home care agency or home care registry".
CF #5, (SOC): 6/24/22; contained no documentation showing the consumer had been provided the following information prior to the start of services: "No individual as a result of the individual's affiliation with a home care agency or home care registry may assume power of attorney or guardianship over a consumer utilizing the services of that home care agency or home care registry. The home care agency or home care registry may not require a consumer to endorse checks over to the home care agency or home care registry".




Interview with Agency owner complete October 25, 2022 at approximately 2:00PM confirmed the above findings.




Plan of Correction:

We will add the below documents to client booklet and have a tracker checklist sheet signed by customer indicating receipt. This tracker sheet will be maintained for all clients - current and future.
1) Updated agreement verbiage reproducing the language in CF#1

2) Updated agreement verbiage reproducing the language in CF#2

3) Updated agreement verbiage reproducing the language in CF#3

4) Updated agreement verbiage reproducing the language in CF#4

5) Updated agreement verbiage reproducing the language in CF#5

We can provide the updated agreement reflecting these to the agency upon approval of PoC.
